1. Data Collection
We collect only the absolute minimum data required to execute the artistic ritual and deliver the artifact. This includes:
- Identification: First Name, Last Name.
- Contact: Email address, Phone number.
- Context: Your response to "Why does this resonate with you?" (used solely for session preparation).
2. Use of Data
Your data is used exclusively for:
- Scheduling and managing your EXISTOS session.
- Drafting the Certificate of Authenticity.
- Direct communication regarding logistics.
We do not use your data for marketing newsletters, tracking, or algorithmic profiling. We do not sell data.
3. Third-Party Processors
To ensure technical functionality, limited data passes through:
- FormSubmit: Used to securely transmit your reservation request.
- Hosting Provider: Stores site infrastructure logs (IP addresses) for security purposes.
4. Data Retention & Deletion
Personal contact data is retained only as long as necessary to complete the transaction and comply with Lithuanian tax laws. You have the right to request the deletion of your personal data ('Right to be Forgotten') by contacting us at albert@pocej.com.
Terms of Use & Sale
1. The Nature of the Service
EXISTOS is not a standard photography service. It is a performative art commission. By reserving a session, the Client acknowledges that:
- The process results in one (1) single exposure.
- There are no "retakes" or "options" to choose from.
- The result is an interpretation of reality by the Artist, Albert Pocej.
- Technical perfection is secondary to emotional authenticity.
2. The Artifact & Intellectual Property
This agreement defines the unique ownership structure of EXISTOS:
- Physical Ownership: The Client owns the physical print (The Artifact) outright.
- Intellectual Property: The Artist retains the copyright and moral rights to the image as the creator.
- The Covenant of Singularity: The Artist contractually agrees NOT to reproduce, reprint, license, or publish the digital source of the Client's portrait. The digital source is destroyed or permanently archived offline solely for legal proof of authorship, never for reproduction.
- Client Restrictions: The Client agrees not to produce commercial reproductions of the Artifact.
3. Booking & Cancellation
- A session is confirmed only upon agreement of date and location.
- Cancellations made less than 48 hours before the session may be subject to a cancellation fee to cover incurred logistical costs.
- In the event of technical failure (camera malfunction, data corruption), the Artist's liability is limited to a full refund or a re-shoot at no additional cost.
4. Governing Law
These terms are governed by the laws of the Republic of Lithuania. Any disputes shall be resolved in the courts of Vilnius.
